Hi Adam, it's not so much the timescale that counts but where/how the infrastructure was agreed. With the Covid-era temporary stuff, which many councils pulled out before their trials were over, like K&C, many weren't in boroughs' LIPs (Local Implementation Plans) but in separate emergency plans. If they had been in LIPs they would potentially be impacted by this ruling. The LIP is the key here - it's a document agreed between TfL and boroughs on how the borough will help deliver the Mayor's Transport Strategy and boroughs are expected to hold up their end of the bargain
